I run into exactly this kind of problem: independently of the value of the
checkbox the form always submitted.
My plan is to block the submitting, until the user check in the checkbox.
In my case it is necessary to block submitting, so, I use my hack to provide
this function, but now I know, how to store customfields to document other
requests, thank you a lot!
Anyway, I made a small change in the captcha:
If somebody calculates the result, he must +10 to get the good value.
Example:
56-16= [ ] please calculate the result and increase it by ten
With this little modification I eliminated a lot of spams. Probably seems
stupid, but seems working (except somebody do not read the
instruction…).

That way, the Accept Terms is documented too, but if it is mandatory, the
documentation is worth not much.
On second thought, maybe a mandatory on a checkbox will not work at all, as
it is checked or unchecked,
and always has a value.
